The May 2017 edition of the Illinois Trial Court Divorce Digest featured Dussias Wittenberg Koenigsberger attorney Judd Z. Fineberg for his success on behalf of a client whose former wife attempted to claim a share of his disability payments as marital property. Mr. Fineberg effectively argued that, while the marital settlement agreement did award a portion of his client’s retirement benefits to the man’s former wife, his disability payments were not included in that agreement. In her ruling in this case, Judge Nancy J. Katz noted, “The agreement was unambiguous. It talked about the retirement pension and no other benefits that were part of that package.”
